YFS Terms of Service

1. About YourFootballShirt.com

YourFootballShirt.com (“YFS”, “the Platform”, “we”, “our”, “us”) is a football shirt collector community and marketplace operated by Sebastien Bee, based in France. By accessing or using our website, mobile application, or any related services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Platform.

2. Eligibility

You must be at least 16 years old to create an account and use YFS. By registering, you represent that you meet this age requirement and that the information you provide is accurate and complete.

3. Account Registration

To access certain features (collecting, selling, messaging, auctions), you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to:

Provide accurate and up-to-date information
Not create multiple accounts for fraudulent purposes
Not share your account credentials with third parties
Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Collector Features

YFS provides tools for football shirt collectors, including:

Digital kit collection management
Public collector profiles
Kit visibility controls (public/private)
Kit transfers between collectors
Wishlist
Leaderboard, Legend Status, and Rewards
Activity feed
Photomatch tool for matchwear authentication
Instagram Import (importing posts from your Instagram account)

All content you upload (images, descriptions, collection data) remains your property. By uploading content to YFS, you grant us a non-exclusive, worldwide, royalty-free licence to display, store, and distribute that content within the Platform for the purpose of providing our services. This licence ends when you delete the content or your account.

5. Instagram Import

The Instagram Import feature allows you to connect your Instagram Business or Creator account and import your football shirt posts into your YFS collection. By using this feature:

You authorise YFS to access your Instagram media feed (photos and captions) through the Instagram API
You confirm that you own or have the right to use the content you import
You can disconnect your Instagram account at any time, which immediately revokes our access
Imported content (photos and descriptions) becomes part of your YFS collection and is governed by these Terms

Our use of Instagram data is also governed by Meta’s Platform Terms and our Privacy Policy.

6. Marketplace

YFS operates a marketplace where users can list football shirts for sale. By using the marketplace as a seller, you agree to:

Provide accurate descriptions and genuine photographs of items
Ship items within the timeframe specified in your listing
Not list counterfeit, stolen, or prohibited items
Honour accepted offers and completed sales
Comply with all applicable consumer protection laws

By using the marketplace as a buyer, you agree to:

Complete payment for items you purchase
Communicate respectfully with sellers
Raise any disputes within a reasonable timeframe

YFS acts as an intermediary platform. We are not a party to transactions between buyers and sellers. We do not guarantee the authenticity, quality, or condition of items listed by third-party sellers. We encourage buyers to use the Photomatch tool and request detailed photos before purchasing.

7. Seller Obligations

To sell on YFS, you must complete the seller registration process and may be required to submit identity verification. Sellers are responsible for:

Setting accurate prices
Paying applicable platform commissions on sales
Fulfilling orders promptly and as described
Handling returns in accordance with applicable consumer protection laws (including the EU 14-day withdrawal right for distance sales, where applicable)
Declaring and paying any applicable taxes on their sales income

YFS reserves the right to remove listings or suspend seller accounts for repeated violations, fraudulent activity, or selling counterfeit items.

8. Auctions

YFS provides an auction system with proxy bidding and anti-snipe protection. By participating in auctions:

Bidders: By placing a bid, you commit to purchasing the item at the final price if you are the winning bidder. Bids are binding. You must maintain sufficient funds in your Auction Wallet to cover your active bids.
Sellers: By listing an item for auction, you commit to selling the item to the highest bidder at or above any reserve price set.
Wallet holds: YFS may place temporary holds on your Auction Wallet balance to secure your bids. These holds are released when you are outbid or the auction concludes.

9. Make Offer System

The Make Offer feature allows buyers to propose a price for listed items. An offer becomes binding upon acceptance by the seller. Once accepted, both parties are expected to complete the transaction.

10. Payments

Payments on YFS are processed by third-party payment providers (PayPal, Stripe). YFS does not store your full payment credentials. By making a purchase, you agree to the payment provider’s terms of service.

Auction Wallet top-ups are processed via PayPal and are used exclusively within the YFS auction system.

11. Prohibited Conduct

You agree not to:

List or sell counterfeit, replica, or stolen items
Misrepresent the condition, authenticity, or origin of items
Harass, abuse, or threaten other users
Use the Platform for spam, phishing, or fraudulent activity
Attempt to circumvent platform commissions or fees
Scrape, crawl, or use automated tools to extract data from YFS without permission
Interfere with the operation or security of the Platform
Create fake accounts, fake reviews, or manipulate the leaderboard

12. Intellectual Property

The YFS platform, including its design, code, logos, and branding, is the property of YourFootballShirt and is protected by intellectual property laws. You may not reproduce, modify, or distribute any part of the Platform without our prior written consent.

User-generated content (kit photos, descriptions, reviews) remains the property of the respective users. By uploading content, you grant YFS the licence described in Section 4.

13. Content Moderation

We reserve the right to remove or modify any content that violates these Terms, is fraudulent, offensive, or otherwise inappropriate. We may act on reports from other users or through our own moderation processes.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

YFS is provided “as is” without warranties of any kind, express or implied
We do not guarantee that the Platform will be uninterrupted, error-free, or secure
We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform
We are not responsible for the conduct of other users or the quality, safety, or legality of items listed on the marketplace
Our total liability to you for any claims arising from your use of YFS shall not exceed the fees you have paid to us in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by applicable law.

15. Dispute Resolution

If a dispute arises between a buyer and seller, we encourage both parties to resolve it directly through our messaging system. YFS may, at its discretion, mediate disputes but is not obligated to do so.

For disputes between you and YFS, these Terms are governed by French law. Any legal proceedings shall be brought before the competent courts in France.

For EU consumers: you have the right to submit a complaint through the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Privacy

Your use of YFS is also governed by our Privacy Policy, available at https://yourfootballshirt.com/privacy-policy/. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

17. Cookies

We use cookies and similar technologies as described in our Privacy Policy. Essential cookies are required for the Platform to function. Non-essential cookies (analytics, third-party services) are only set with your consent via our cookie banner.

18. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Your continued use of YFS after changes take effect constitutes acceptance of the revised Terms.

19. Termination

You may delete your account at any time by contacting us at yo***************@***il.com. We may suspend or terminate your account if you violate these Terms, with or without notice.

Upon termination:

Your access to the Platform will be revoked
Your public profile and collection will no longer be visible
Active listings will be removed
Data retention will follow our Privacy Policy (Section 5)

20. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force
Our failure to enforce any right or provision does not constitute a waiver of that right
These Terms constitute the entire agreement between you and YFS regarding your use of the Platform
